NightPause Terms of Use

1. Agreeing to these terms
By installing or using NightPause you agree to these terms. If you don't agree, please don't use the app. You must be at least 18, or the age of majority where you live if that is higher, to use NightPause.
2. What NightPause is
NightPause is a focus tool. During times you choose, it uses Apple's Screen Time features to pause the apps, categories and websites you select, and it offers a short break and some wind-down activities.
NightPause is not a medical product. It does not diagnose, treat or prevent insomnia, addiction or any other condition, and nothing in the app is medical advice. If you are concerned about your sleep or your health, please speak to a qualified professional.
3. What NightPause can and can't do
- Restrictions rely on Apple's Screen Time features and on your permission, which you can withdraw at any time in Settings › Screen Time.
- Blocking is not tamper-proof. You can skip a night, end a session, take a break, remove permission or delete the app.
- Restrictions may start or end late, or not apply, because of things outside our control, such as your device being off, system updates, or changes Apple makes to Screen Time.
- The morning summary shows only what NightPause itself recorded. It does not measure sleep or overall phone use.
Don't rely on NightPause where a missed or late restriction could cause harm.
4. Your licence
We give you a personal, non-exclusive, non-transferable licence to use NightPause on Apple devices you own or control, as permitted by the App Store's usage rules. You may not copy, modify, reverse-engineer, resell or redistribute the app, except where the law gives you that right regardless of these terms.
5. Free plan and NightPause Plus
NightPause can be used for free. NightPause Plus is an optional auto-renewing subscription that adds further features, described in the app at the time you subscribe.
- Price and period. The price and billing period (monthly or yearly) are shown in the app before you buy, in your local currency.
- Free trial. If you are eligible, a subscription may start with a free trial of the length shown in the app (currently 3 days). When the trial ends, the subscription begins and you are charged the price shown, unless you cancel at least 24 hours before the trial ends. A trial is available once per Apple Account.
- Renewal. Subscriptions renew automatically at the end of each period, at the then-current price, until you cancel. Cancel at least 24 hours before the end of the period to avoid the next charge.
- Managing and cancelling. You manage and cancel in your App Store account settings, or from Settings › Manage subscription in the app. Deleting the app does not cancel a subscription.
- Payment and refunds. Purchases are processed by Apple under Apple's terms. Refund requests are handled by Apple at https://reportaproblem.apple.com. We don't issue refunds directly, because we never receive your payment details. This does not affect any right to a refund or other remedy you have under the law where you live, including the Australian Consumer Law.
- After cancelling or expiry. Plus features stop at the end of the paid period. Your settings are kept; schedules beyond the free plan's limit stay stored but are not applied.
- Price changes. If the price changes, Apple will notify you and, where required, ask for your consent before the new price applies.
6. Your data
NightPause stores its data on your device and has no accounts or servers. See the Privacy Policy. You can erase everything the app has stored in Settings › Delete local data.
7. Changes to the app
We may add, change or remove features, and we may stop offering the app. If we remove a paid feature you are currently paying for, you may cancel, and you may ask Apple for a refund covering the unused part of your current period. Any rights you have under consumer law still apply.
8. Disclaimers
To the extent the law allows, NightPause is provided "as is" and "as available", without warranties of any kind, including that it will be uninterrupted, error-free, or will achieve any particular result for your sleep or habits. Nothing in these terms removes rights you have under consumer law that cannot be excluded. In Australia, our services come with guarantees that cannot be excluded under the Australian Consumer Law.
9. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, or for losses caused by restrictions that did not apply, applied late, or were bypassed. Our total liability to you is limited to the amount you paid for NightPause Plus in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
10. Governing law
These terms are governed by the laws of the Australian Capital Territory, Australia, and its courts have non-exclusive jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live.
11. Apple
These terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide support for it, and is not responsible for claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. You confirm you are not located in a country under a US Government embargo and are not on a US Government list of prohibited or restricted parties.
12. Changes to these terms
We may update these terms. The current version will be posted on this page with a new effective date. If a change is significant, we will tell you in the app before it takes effect. Continuing to use NightPause after that means you accept the updated terms.
